Terms and Conditions
1. Acceptance of Terms
By creating an account or using LekkerRaffle (whether as an operator or a buyer), you agree to these Terms and Conditions. If you do not agree, do not use the platform. These terms are governed by the laws of the Republic of South Africa.
2. The Platform
LekkerRaffle is a raffle management platform operated by DevKwagga. The platform allows approved operators to create and manage raffles, and allows buyers to purchase raffle tickets. LekkerRaffle facilitates the platform only — it is not a party to individual raffle transactions between operators and buyers.
3. Operator Accounts
Operators must apply for an account and are subject to vetting and approval by DevKwagga. Approval may be declined or revoked at DevKwagga's sole discretion. By applying, operators confirm that:
- All information provided is accurate and truthful
- They intend to run legitimate raffles with genuine prizes
- They will pay out prizes to winners promptly
- They are at least 18 years of age and legally permitted to run raffles in their jurisdiction
4. Operator Responsibilities
Operators are solely responsible for:
- The legality of their raffles in their jurisdiction
- Accurately describing prizes and their value
- Delivering prizes to winners within a reasonable time
- Handling buyer complaints and disputes
- Ensuring their PayFast merchant account is configured and in good standing
- Complying with all applicable laws, including the Lotteries Act
LekkerRaffle is not liable for any failure by an operator to pay out prizes, deliver goods, or comply with applicable law.
5. Buyer Responsibilities
Buyers purchase tickets at their own risk. Ticket purchases are non-refundable except where a raffle is cancelled by the operator or where a refund is issued at the operator's discretion. Buyers must provide accurate contact details when purchasing tickets.
6. Draw Integrity
All draws are conducted using a cryptographically secure random number generator on LekkerRaffle's servers. The spinning wheel animation shown in the operator app is purely visual and is not the source of randomness — the winner is determined server-side before the animation plays. LekkerRaffle does not manipulate or influence draw outcomes.
7. Payments — Buyers
Ticket payments are processed by PayFast and paid directly into the operator's PayFast merchant account. LekkerRaffle does not hold or process buyer funds. Refunds, where applicable, are processed by the operator via PayFast.
8. Billing — Operators
Operators are charged R1.00 (one rand) per ticket sold, calculated across all their raffles. Invoices are generated every 30 days from the date the operator's account is activated. Invoices are payable within the due date shown on each invoice.
Non-payment consequences:
- Invoices more than 3 days overdue will result in the operator's account being suspended. While suspended, buyers cannot purchase tickets and no new raffles may be created.
- Continued non-payment may result in permanent account termination.
- Suspended accounts are reinstated automatically once the outstanding invoice is paid and confirmed by DevKwagga.
- Operators remain liable for all outstanding invoices even after account termination.
Invoice payments are processed via PayFast to DevKwagga's merchant account.
9. Store Credit
LekkerRaffle may issue store credit to buyers as compensation for cancelled raffles or failed refunds. Store credit has no cash value and cannot be withdrawn — it may only be used to purchase tickets on the LekkerRaffle platform.
10. Prohibited Uses
You may not use LekkerRaffle to:
- Run fraudulent, deceptive, or illegal raffles
- Sell tickets for prizes you do not own or cannot deliver
- Harass, defraud, or mislead buyers
- Attempt to manipulate draw outcomes
- Circumvent the billing system
- Use automated tools to scrape or abuse the platform
11. Intellectual Property
The LekkerRaffle name, logo, and platform are the property of DevKwagga. Operators retain ownership of their raffle content (titles, descriptions, and prize images). By uploading content, operators grant DevKwagga a non-exclusive licence to display that content on the platform.
12. Limitation of Liability
To the maximum extent permitted by South African law, DevKwagga is not liable for:
- Any loss or damage arising from an operator's failure to pay out prizes
- Payment disputes between operators and buyers
- Loss of revenue or data resulting from platform downtime
- Any indirect, incidental, or consequential damages
LekkerRaffle's total liability to any party shall not exceed the amounts paid by that party to LekkerRaffle in the 3 months preceding the claim.
13. Termination
DevKwagga may suspend or terminate any account at any time for breach of these terms, non-payment, or fraudulent activity. Operators may request account closure by emailing jixjansen@gmail.com. Outstanding invoices remain payable after termination.
14. Changes to These Terms
DevKwagga may update these terms at any time. Continued use of LekkerRaffle after updated terms are posted constitutes acceptance.
15. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
